These terms apply to everything you do on dannadi.com, a site operated by Danna Diana Pérez López, under the artist name DannaDi, en Hermosillo, Sonora. By buying, bidding, requesting a quote, signing up for a workshop or donating, you accept these terms and the privacy notice.
1. The works
- All works are original and handmade, unless stated to be digital or reproductions.
- The photos show each work as faithfully as possible, but color may vary slightly depending on your screen.
- Each work is unique. If two people want it at the same time, it goes to whoever pays first.
2. Prices and payments
- Prices are in Mexican pesos (MXN). Shipping is quoted separately by destination and size.
- We accept PayPal, Mercado Pago, bank transfer and in-person payment in Hermosillo, Sonora. We do not store card data.
- Your order is confirmed when we receive full payment. If it is not received within 48 hours, the work becomes available again.
- If you need a Mexican tax invoice (factura), ask for it when you buy.
3. Shipping and delivery
- Shipping anywhere in Mexico. The cost is quoted by destination and size of the piece.
- Works are packed with protection for transport. We share the tracking number when your order ships.
- You can also pick up your work in Hermosillo, Sonora, by appointment.
4. Exchanges and returns
- If your work arrives damaged or is not what you bought, let us know within 5 business days of receiving it, with photos of the packaging and the work. We will replace it, repair it or refund your money.
- For works that were already finished, you have 5 business days from receipt to cancel your purchase, returning it in the same condition and packaging. Return shipping is at your expense and the refund is made once we receive the work.
- Commissioned works are made especially for you, so they cannot be returned except for defects.
5. Commissions and quotes
- Requesting a quote commits you to nothing.
- A 50% deposit reserves your spot. The balance is paid on delivery of the work.
- The delivery time is agreed in the quote and starts once the deposit and reference photos are received.
- We share progress with you. Minor adjustments during the process are included; changing the idea, size or medium once the work has started is quoted separately.
- If you cancel after the work has started, the deposit is not refunded because it covers materials and work already done.
- The photos you send must be yours or you must have permission to use them.
6. Auctions
- Every bid is a commitment to buy. By bidding, you agree to pay the amount offered if you win.
- If there is a bid in the last 5 minutes, closing is extended 5 more minutes.
- The winner receives an email and has 48 hours to pay. If they do not pay, they lose the work and it is offered to the next highest bid. Anyone who does not pay may be excluded from future auctions.
- We may cancel bids that appear fake or made in bad faith.
- In charity auctions, the stated percentage is delivered to the cause when the winner pays, and it is published on the Art for a cause page.
- Shipping for auctioned work is quoted separately.
7. Workshops
- Your spot is confirmed once payment is received. The presale price applies only to the stated number of spots.
- If you cancel more than 72 hours in advance, we refund your payment or move it to another date. With less than 72 hours there is no refund, but you can give your spot to someone else by letting us know.
- If we cancel or change the date, we refund 100% or move you to the new date, whichever you prefer.
- Workshops that include alcoholic drinks are for ages 18 and over only.
- By attending you agree that photos of the group and the work may be taken to share on social media. If you do not want to appear, let us know when you arrive.
8. Donations and Art for a cause
- Donations are received by DannaDi and delivered to the chosen cause. Each delivery is published with date and amount on the Art for a cause page.
- Donations are not tax deductible and are non-refundable, unless made by mistake. In that case write to us within 5 days.
9. Copyright
- Each work, its photos and the site's texts are protected by Mexico's Federal Copyright Law (Ley Federal del Derecho de Autor). The rights belong to the artist who created each work.
- When you buy a work you acquire the physical piece. This does not include the right to reproduce, print or use it for commercial purposes, unless agreed in writing.
- The artist may photograph and show commissioned works in her portfolio and social media, unless you ask her not to.
10. Artists' collective
- Collective artists keep the rights to their work.
- For each sale made through the site, DannaDi keeps a commission of 20% to cover promotion, platform and customer service. The rest is paid to the artist when the sale is completed.
- Each artist is responsible for the originality of the work they publish.
11. Use of the site
- Copying the site's content, trying to access the admin panel without authorization or using the forms to send spam is not allowed.
- We may correct price or availability errors. If you already paid for a work at a wrong price, you can choose between paying the difference or getting a full refund.
12. Contact, complaints and jurisdiction
For any question or clarification write to danna@dannadi.com or on WhatsApp at +526624043289. We aim to resolve everything directly with you. If you are not satisfied, you can go to Mexico's Federal Consumer Protection Agency (PROFECO).
These terms are governed by the laws of Mexico. For any dispute, the parties submit to the competent courts of Hermosillo, Sonora.
